Ordinance No. 1053

BE IT ORDAINED by the Town Council of the Town of Speedway, Indiana that Section 6.38.020 of Chapter 6.38 of the Speedway Municipal Code is amended to read as follows:

"6.38.020 Charges- Billing-Exception. Each residential user shall be charged a monthly amount for mandatory curbside recycling based on the per residence cost of the contractor who is awarded the contract to collect recyclable materials, plus an administrative charge to cover the Town's cost of billing and collection. The recycling charge shall be added as a separate item to each residential property owner's monthly water bill and shall be billed and collected by the Town. Regardless of how payments may be designated, partial payments of a combined water, garbage and trash collection, recycling and sewer bill shall be applied first to the water bill, second to garbage and trash collection bill, third to the recycle bill and last to the sewer bill. The recycling charge shall apply irrespective of whether the residential user complies with mandatory curbside recycling; the single exception being if the residential user has water to the residence shut off at the water meter. During such period of water shut-off, the residential user shall not be billed or charged for water usage or curbside recycling."
