AN ORDINANCE TO AMEND CHAPTER 10.12 OF THE SPEEDWAY MUNICIPAL CODE CONCERNING PARKING RESTRICTIONS ON MAIN STREET

WHEREAS, the Town Council of the Town of Speedway, Indiana (the "Town") has determined it necessary to provide for parking restriction on Main Street.


NOW THEREFORE, BE IT ORDAINED by the Town of Speedway, Indiana that Chapter 10.12 of the Speedway Municipal Code is amended to read as follows:


Section 1. Section 10.12.200 of the Speedway Municipal Code is deleted and replaced with the following:

"10.12.200 Parking restrictions within a certain geographic area at times in proximity to racing events at the Indianapolis Motor Speedway. No person shall park a vehicle on the south and east sides of any street within the area bounded by 25th Street on the north, Lynhurst Drive on the west, Crawfordsville Road on the south, and Georgetown Road on the east, during major racing events (as granted by the Town of Speedway, Indiana) at the Indianapolis Motor Speedway, from 6:00 p.m. the day before the racing events (including, but not limited to practices qualifications and the race) begin until 8:00 p.m. the day of the running of the race, or, if the race is postponed, on a day-to-day basis following the scheduled day of the race until 8:00 p.m. of the day the race is completed."


Section 2. Section 10.12.220 of the Speedway Municipal Code is added to read as follows:

"10.12.220 Parking restrictions on Main Street.

A. Parking on both sides of Main Street between 10th Street and 16th Street shall be limited to three (3) hours from Friday starting at 12:00 a.m. until Saturday at 11:59 p.m. prior to race day events (as granted by the Town of Speedway, Indiana) at the Indianapolis Motor Speedway and also qualification weekends for the Indianapolis 500 Mile Race held at the Indianapolis Motor Speedway to include Friday at 12:00 a.m. until Sunday at 11:59 p.m.

B. There shall be no parking on Main Street between 10th Street and 16th Street on a race day event (as granted by the Town of Speedway, Indiana) at the Indianapolis Motor Speedway.

C. Any vehicle parked in violation of this section is a public nuisance and presents a threat to the public health, safety and welfare of the Town. In addition to penalties provided in Chapter 10.28, any police officer, upon discovering any vehicle parked in violation of this section, may remove such vehicle or cause to be remove such vehicle to any Town-owned property or to a private garage or place so authorized by contract, where the vehicle shall be impounded and shall be released only after payment of a fee for towing and storage of the vehicle. The fee for towing or removing a vehicle pursuant to this section shall not exceed the amount which is normally and customarily charged for that service, to which may be added reasonable storage charges to commence after the date that the vehicle is impounded. "

Section 3. This Ordinance shall be effective upon passage.
