Ordinance No. 1097

AN ORDINANCE TO ADD SECTION 2.50 TO THE SPEEDWAY MUNICIPAL CODE AUTHORIZING THE PAYMENT OF CLAIMS

WHEREAS, the Town Council of the Town of Speedway, Indiana, (the "Town Council"), being the governing body of the Town of Speedway, Indiana (the "Town"), desires to reaffirm the pre-approval for payments of claims; and


WHEREAS, pursuant to Indiana Code Section 36-5-4-12, the Clerk-Treasurer of the Town (the "Clerk-Treasurer") may make claim payments in advance of approval by the Town Council for certain types of expenses; and


WHEREAS, the Town Council has determined to authorize the pre-approval for payments of claims as provided in Indiana Code Section 36-5-4-12.


NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SPEEDWAY, INDIANA THAT SECTION 2.50 IS ADDED TO THE SPEEDWAY MUNICIPAL CODE TO READ AS FOLLOWS:


Section 1.


"2.50.010 Payment of Claims. The Clerk-Treasurer may make claim payments in advance of approval by the Town Council for the following types of expenses:


(1) Property or services purchased or leased from:


(A) The United States government; or
(B) An agency or a political subdivision of the United States government.


(2) License fees or permit fees.


(3) Insurance premiums.


(4) Utility payments or utility connection charges.


(5) Federal grant programs if:


(A) Advance funding is not prohibited; and
(B) The contracting party provides sufficient security for the amount advanced.


(6) Grants of state funds authorized by statute.


(7) Maintenance agreements or service agreements.


(8) Lease agreements or rental agreements.


(9) Principal and interest payments on bonds.


(10) Payroll.


(11) State, federal, or county taxes.


(12) Expenses that must be paid because of emergency circumstances.


(13) Copying Expenses related to administrative matters not to exceed $200.00.


Section 2.50.020 Itemized Invoice. Each payment of expenses under Section 1 must be supported by a fully itemized invoice or bill and certification by the Clerk-Treasurer."

Section 2. This ordinance shall be effective upon passage.
