Ordinance No. 1098

AN ORDINANCE TO ADD SECTION 13.17 TO THE SPEEDWAY MUNICIPAL CODE PROVIDING FOR WATER AND SEWER LINE REQUIREMENTS
 
WHEREAS, the Town Council of the Town of Speedway, Indiana, (the "Town Council"), being the governing body of the Town of Speedway, Indiana (the "Town"), desires to provide certain requirements for water and sewer lines; and


WHEREAS, the Town Council has determined that such requirements for water and sewer lines is in the best interests of the Town and its residents.


NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SPEEDWAY, INDIANA THAT SECTION 13.17 IS ADDED TO THE SPEEDWAY MUNICIPAL CODE TO READ AS FOLLOWS:


Section 1.


"13.17.010 Sewers.


1. The responsibility for the maintenance of all sewers, other than main line sewers, shall rest with the property owner. This includes industrial, commercial and residential sewer lines.


2. It is required that a licensed plumber or contractor install, repair or replace the sewer lateral between any building or structure to the main sewer line. This requirement applies to residential sewer laterals as well.


13.17.020 Water Lines.


1. Private water mains and service lines are installed and owned by the property owner. Repair and/or replacement of such lines is the responsibility of the property owner.


2. The Town owns only the water meter and will install, repair and/or replace the water meter at the Town's expense.


3. When the Town makes a service tap on the water main for a customer (up to 2 inches), the Town owns and is responsible for the corporation stop, which attaches the customer's service line to the water main.


4. The Town is responsible for repair and/or replacement of water mains installed at the Town's expense.


5. The Town is responsible for installation, testing, repair and/or replacement of fire hydrant, unless the fire hydrant is designated private and thus is the responsibility of the property owner.


6. It is required that a licensed plumber or contract install, repair or replace the service line between any building or structure and the water main.


13.17.030 Town Responsibility. The Town accepts responsibility for repair and/or replacement of water or sewer lines damaged by either Town Departments or contractors hired by the Town."


Section 2. This ordinance shall be effective upon passage.
